130. Thomas BURNETT
When the birth of Thomas' son Samuel was registered in 1839, place of birth was given as York Castle for the birth certificate. This was where Thomas was living at that time - he was employed as a cook at the Castle. Thomas' brother Barnabus Burnett is also known to have been a cook at York Castle.

Among the "patients" was Thomas BURNETT, widower, [age unreadable], agricultural labourer - retired, born SicklinghallThomas, the husband of Sarah, was baptised at Whixley; which is close to his given birthplace (1851 census) of Green Hammerton. The given birthplace of Aldborough (1881 census) does not 'fit' with a baptism at Whixley, however, two siblings of Thomas were baptised at Aldborough. The given birthplace of Sicklinghall [1891 census] does not fit with Thomas' baptism either, but his brothers Robert and Samuel were born at Sicklinghall.

//Samuel apparently became the Sexton at Wetherby and in 1877 resigned from his post in most unusual circumstances - he reported that he had buried a living man!
"Leeds Mercury" newspaper, 5 Nov 1877:
THE WETHERBY SEXTON'S STORY - An ordinary monthly meeting of the Wetherby Burial Board was held on Friday evening, and the report circulated by Samuel Burnett, the sexton, to the effect that twelve months ago he buried a living man, was investigated. ... Mr Henry Crossley contended that the resignation did not relieve the sexton from the scandalous report he had circulated, which was calculated to bring disgrace upon the Board of Guardians, the workhouse officials, the Burial Board, and the town itself. Mr William Hill, a member of the board, and Mr. T. Greenall then stated that while sitting in the bar of an hotel in the town, the sexton said that when filling in the grave of Lofthouse both he and his son heard several knocks at the coffin.... Mr Wilson, the workshouse master, said deceased was eighty-five years of age. He saw him the day he died, and the doctor saw him the day before. The corpse was three days in the dead-house, and decomposition had set in. He was perfectly satisfied the man was dead. the sexton was called in ... and admitted having told the tale, but said it was in jest. He had heard something in the grave, and so had his son, but he believed it to be caused by water. He did not think that anyone would believe him when he told the story.Same newspaper, 17 Nov 1877:
WETHERBY - Yesterday the first meeting of the newly-elected Burial Board, specially convened for the purpose of electing a sexton to the cemetery was held. there were 16 applicants for the post, rendered vacant by the resignation of Samuel Burnett, and J. GRO Index of Births: birth registration not found.
[Birth of Mary Emma BURNETT was registered during March quater 1861 at York - bearing in mind that her mother was named Emma this may have been the individual who was AKA Ellen BURNETT.]
Alice's origins remain unknown. Her given age at the time of the 1841 census (below) suggests birth between 1807 and 1811 and we know she was born in Yorkshire.
1841 census: HO107/1349/5, folio 52, p18

Frederick SHEARD, 25, hairdresser, Y
Alice do 30, Y
Charles do 6m, Y
/Frederick BURNETT, 5, Y
Elias WILKINSON, 14, hairdresser's app, Y
//Unfortunately, Alice died in 1849, two years before the next census - which would have given a more precise age and a definite birthplace. However, the 5yr old, Frederick BURNETT (above), continued to live with Frederick SHEARD after Alice's death, and future census returns identify him as Fred's "step-son" [see notes for step-father Fred SHEARD]. Frederick BURNETT was therefore Alice's son by a previous relationship. He may have been Alice's illegitimate child or he may have been a child of a previous marriage for Alice. The fact that he was named Frederick, and that Fred SHEARD continued to look after him after his mother's death, might suggest that Fred SHEARD was the father - but it would be entirely wrong to assume this to be the case.
There is one very intruiging possibility. A John BURNETT married Alice HAIGH, in 1825, at St. Peter's, Leeds. Only one surviving child is known, son Thomas Bickerdike BURNETT, born in 1832, before John BURNETT died in 1837. At the time of the 1841 census young Thomas B. BURNETT was living with an aunt & uncle, and there was no sign of his mother Alice BURNETT. Perhaps she had married Fred SHEARD? It is quite possible that John & Alice BURNETT had another son, named Frederick, born in 1835, and that when John died, and Alice re-married, she took the youngest son with her and the elder son went to live with his aunt & uncle. Further circumstantial 'evidence' to support this is provided by the fact that Thomas B. BURNETT, Alice's older son, became a hairdresser, and later was described in census returns as "hairdresser and ironmonger" and "ironmonger". Fred SHEARD, in census returns 1851 - 1871, was first a hairdresser, then a hairdresser & general dealer, before becoming an ironmonger. Was there a 'family' connection between these two individuals? Is that what influenced young John Bickerdike BURNETT's choice of career?
While there is some doubt about the identity of Alfred BURNETT's father, there is no doubt that his mother was Alice BURNETT. There is only one question remaining - was Alice the former Alice HAIGH, and a widow at the time she married Fred SHEARD, or was she a spinster? My money's on the former. A copy certificate for the 1838 marriage should provide an answe
164. Thomas BURNETT
Thomas 'inherited' land known as "Gawber Gills" at Husthwaite when his mother Eleanor died in 1817. Tenancy of this land was transfered to Thomas at the Court Leet of the Manor of Husthwaite held on 23 Apr 1818. Thomas was only 14yrs old at the time and his step-father, Joseph BURNETT, acted on his behalf.
Years later, at the Court Leet of the Manor of Husthwaite held on 25 Apr 1860, "... Thomas BURNETT of Stockton-on-Tees in theCounty of Durham, and Mary his wife... 171. Joseph BURNETT
From the age given in 1871 census returns Joseph was born c1816 and he stated that he was born in Balk, Yorkhire. It is therefore highly likely that he was the son of Joseph & Eleanor BURNETT. Joseph Snr. was Eleanor's brother-in-law [her first husband was Joseph's brother Thomas BURNETT who died in 1813] Joseph & Eleanor married in 1815 and IGI has the baptism of Joseph son of Joseph and Ellen BURNETT at Bagby on 28 Jul 1816. Mary A. JACKSON was obviously not James BURNETT's wife, as given in the census return, and since she was described as "married" it would appear that she was not his wife's daughter from her first marriage to George JACKSON. However, this may have been a smoke-screen to hide the fact that 6yr old Janet JACKSON was Mary's illegitimate daughter and granddaughter of James' wife Ann.1881 census: RG11/4820, folio 152, p9

//GRO Index of Deaths: BURNETT, James, Dec 1885, Thirsk, 9d 250. Age 81.
Ann was born at Helperby in 1801, one of three daughters of John ARCHER and his wife Martha HERRING; who married at Brafferton 29 Aug 1796. Ann married first husband George JACKSON on 29 Nov 1824 at the parish church of Holy Trinity, Goodramgate, City of York. There was at least one child of this marriage, a daughter named Mary Ann born c1825. Mary Ann JACKSON and her presumed illegitimate daughter Janet were living with her mother Ann and step-father James BURNETT in Bagby near Thirsk at the time of the 1861 census [see notes for James BURNETT]. It is not known if there were any other children of Ann's first marriage before George JACKSON died.
Ann JACKSON, widow, married James BURNETT in 1841 at the parish church of St. Crux, City of York. Just months before their marriage Ann and James were recorded together in 1841 census returns working as servants to Martin STAPYLETON at Myton Hall, Myton on Swale.
