At the Court Leet and Court Baron of the Manor of Husthwaite held on 17 Oct 1839, Timothy BURNETT of Husthwaite mortgaged property and land at Husthwaite, for £1000, to Richard TENNANT. This was shortly after Timothy married his wife Mary WARE.

Jane was granted letters of administration after her mother Mary Jane BURNETT died in 1885. Two weeks later she was also granted letters of administration of her father's estate. Her father Timothy BURNETT had died ten years earlier and had left a will - annexed to the letters of administration.

Next door neighbours in Sicklinghall - these two households reveal the relationships between the GARFORTH and BURNETT families. John Wm G. BURNETT was the son of William and second wife Harriet whose maiden name was GARFORTH. The widow Jane GARFORTH was almost certainly Harriet's mother.

The GRO Index of Deaths for the June quarter 1877 lists a William BURNETT, age 95, who died in the Wetherby District. Though the given age at death is not quite consistent with his birth in 1784 this was undoubtedly the death of William BURNETT of Sicklinghall.

The National Probate Index contains the following entry:
William BURNETT of Sicklinghall, farmer, died 3 Jun 1877. Will proved at London, 27 Jun 1877. Without doubt the man listed in the GRO Index of Deaths. The will was proved by William GARFORTH of Bramley, labourer, sole executor - obviously a close relative of William BURNETT's second wife Harriet.


131. Sarah BURNETT

Sarah's parents lived at Green Hammerton - according to the entry for her baptism in the Whixley parish register. Her older brother Thomas (b:1806] and younger brother William [b:1813] both gave their birthplace as Green Hammerton for future census returns. It is reasonable to assume that Sarah was born at Green Hammerton.

Sarah married William ELSWORTH in 1830 - William was the brother-in-law of Sarah's brother Thomas [who married Sarah ELSWORTH]
William & Sarah ELSWORTH had six children. They were the ancestors of Robert WELBOURNE - contact made via the YORKSGEN Internet mailing list March 2006.

The given age [56] and birthplace [Sicklinghall] for Samuel identify him as the son of William and Sarah BURNETT, baptised at Kirkby Overblow on 23 May 1824.

Mary DOWNING

Mary was born in 1809 at Fishlake, the eldest daughter of James DOWNING and his wife Sarah FOSTER. She was baptised at Fishlake on 18 Jun 1809 - the baptism entry in the parish register gives her date of birth 25 May 1809.


135. Isabella BURNETT

IGI lists the baptism of Isabella BURNETT, at Aldborough, on 28 May 1816, and names her parents as William and Sarah BURNETT. A search of the original parish register for Aldborough did not find this baptism. However, much of the IGI was compiled from Bishop's Transcripts [BT] and it is likely that Isabella's baptism was ommitted, in error, from the original register, but was included in the BT.


Harriet GARFORTH

According to census returns Harriet, wife of William BURNETT of Sicklinghall, was born c1843 at Sicklinghall.

1861 census returns show Harriet as the 17yr old wife of William BURNETT, age 76yrs. The vast age difference is confirmed in 1871 census returns which show Harriet age 27yrs and husband William age 85yrs [see notes for husband William BURNETT] It would have been understandable, because of the great age difference, if the couple hadn't wanted to go public. Their marriage was registered, during the December quarter of 1860 at Wetherby, but the ceremony may have been at the register office rather than in a church.

1871 census returns show William and Harriet BURNETT living next door to a John GARFORTH, unmarried, who had "nephew" John Wm. G. BURNETT age 9yrs living with him. John Wm G. BURNETT was the son of William & Harriet BURNETT - which confirms that Harriet's maiden name was GARFORTH; John GARFORTH being her brother. Living with William & Harriet at this time was a 'visitor' named Jane GARFORTH, a widow age 64yrs, born East Keswick, who was their "housekeeper". Jane GARFORTH was without doubt Harriet's mother.

William BURNETT died in 1877 age 93yrs, leaving Harriet as a 34yr old widow with two teenage children; son John Wm. G. and daughter Harriet jnr.

Harriet then appears to have moved to the Malton area - she registered the birth of son Tom William there during the June quarter 1881 and both her son John Wilmot G. and her daughter Harriet married in the Malton District in the period between 1881 and 1891 censuses.

There is no doubt that the following census return features Harriet, her surname incorrectly recorded as BENNETT, with her new-born son Tom William, but who was her supposed "husband" George BENNETT?:

Is it possible that 'husband' George BENNETT was in fact the grandson of Harriet's late husband William BURNETT? William's son Thomas by his first wife Sarah HOLDGATE, had a son named George born in 1844 at Sicklinghall. George was about the same age as Harriet, who was born c1843. It's an intruiging possiblity.

Martha COATES was Ann BURNETT's daughter - her given age and birthplace fit with the baptism of Martha, daughter of John and Ann BURNETT, at Great Ouseburn, on 18 May 1822.

Granddaughter Emma BURNETT in the 1851 census extract is thought to have been the illegitimate daughter of Ann BURNETT jnr. [see 1841 census extract above] whose whereabouts at the time of the 1851 census have not been found.

1871 census: still at Great Ouseburn. Widow age 80yrs, former schoolmistress, birthplace Asenby. Edward COUTES [sic], widower, age 54yrs, William COUTES [sic], his wife Martha and their three children, were also living with Ann as "lodgers".

Ann is thought to have had an illegitimate child, a daughter named Emma, in c1850. Emma BURNETT, age 1yr, was living with Ann's widowed mother Ann BURNETT in Great Ouseburn at the time of the 1851 census.


104. John BURNETT

A named beneficiary of the will of his brother William BURNETT of Crayke in 1852.

John BURNETT's marriage to Jane BICKERDIKE at Kirby Hill near Boroughbridge in 1795 was by licence. Unfortunately the licence bond appears not to have survived - this would have given some indication of John's age at the time and might have helped to 'confirm' that he was the son of Robert BURNETT and his wife Mary, nee TEMPLE. However, the entry for the marriage in the Kirby Hill parish register describes John as "bachelor of Houthwaite [sic]" and the marriage was witnessed by Robert BURNETT and Thomas BURNETT - who could well have been John's brothers.

There were no baptisms of children of this marriage recorded in the Kirby Hill register but there were a number of baptisms of children of John & Jane BURNETT entered in Roman Catholic registers at Leeds between 1800 and 1813. One of these children, son John, married in 1825 and named his only known child Thomas Bickerdike BURNETT.

154. Helen BURNETT

Baptised as Helen but obviously known as Ellen. She married John DOBSON at Rothwell in 1829 and had ? children, including a daughter named Jane Bickerdike DOBSON [the middle name being her maternal grandmother's maiden name].


155. Stephen BURNETT

Stephen BURNETT fell foul of the law in 1827, when he would have been just 14yrs old. At Leeds Borough Sessions, on 15 Oct 1827, he was indicted, along with two other boys, for stealing thirty pieces of silver, the property of a Mr. William BENSON, of Leeds. The "Leeds Mercury" newspaper of 20 Oct 1827 carried a report of the proceedings and stated that the three "... were pronounced guilty, and as they had all been previously convicted at the Sessions, the Court expressed no hope of their future amendment, and transported them for seven years."

Stephen must have spent eight months on one of the prison 'hulks' in the Thames - he was one of 178 prisoners who sailed from London on 30 Jun 1828 aboard the ship "Marquis of Hastings". The journey to New South Wales in Australia took 104 days - the ship arrived in Sydney on 12 Oct 1828.

An index to records held by the New South Wales Government shows that Stephen served out his sentence in Australia and was issued with his 'certificate of freedom' on 10 Jan 1835. It is not known if he remained in Australia or returned home to England.

105. Hannah BURNETT

Hannah was without doubt a 'cousin' of her husband Robert BURNETT but exactly what degree of kinship they shared is not known with any degree of certainty. She is most likely to have been Robert's first cousin once removed, the daughter of his cousin Robert BURNETT and his wife Mary TEMPLE. However this Hannah was not baptised until 1767 and if she was born during that year would have been just 16yrs old at marriage in 1782. Hannah daughter of Robert & Mary BURNETT would of course have kept her surname if she married Robert BURNETT and the Husthwaite parish register does include the burial record for a Hannah BURNETT age 68 in 1864. The age at death is consistent with birth in 1766 and this Hannah was not described as a spinster [though she wasn't described as a widow either].


Robert BURNETT

"Robert BURNETT the younger, of Burley Ing in the parish of Cundall", was the 'purchaser' in a conveyance of property in Easingwold Market Place from Robert WALLER, mercer & grocer, on 14 Oct 1769, and was "admitted as tenant to the said premises" at a Court Leet of the Manor of Easingwold later that same year. The same property, now divided into two dwellings, was conyeyed to Thomas SMITH, grocer, of the City of York, at a similar Court Leet on 25 Apr 1776.

Robert left a will, dated 27 Feb 1813, proved 26 Mar 1813, which named his son Robert as sole executor and main beneficiary. Also named as beneficiaries were sons Timothy and William and daughters Ann, Hannah Mary and Elizabeth. The will stipulated that sons William and Timothy were each to pay an annual sum to their mother - who was not named - for the rest of her life.

Robert was owner/tenant of a substantial amount of property and land. His will mentions a farm and crops at Fawdington; a freehold house and land at "Allthorpe" in the parish of Alne; a house known as "Tindal House" and land known as "Burnett's Land" at Husthwaite; and a 'recently built' house and land known as "High Marsh", also at Husthwaite.

Robert's wife Hannah BURNETT was almost certainly a fairly close relative, a member of the same branch of BURNETT to which Robert belonged. Her parentage remains unconfirmed but it appears most likely that she was the daughter of Robert BURNETT and his wife Mary, nee TEMPLE. [See notes for wife Hannah BURNETT]

Robert was Churchwarden at Cundall in 1812 and signed the Bishop's Transcript of the Cundall Parish register for that year.


108. Thomas BURNETT

Thomas married Eleanor at Eston, which was her home parish, eighteen months after Eleanor had an illegitimate daughter baptised there. It is not certain that Thomas was the father of the child - a girl named Elizabeth. Thomas was a butcher and would have made regular visits to the markets at Eston, Stokesley etc. It is quite likely that he met Eleanor during one such visit.

Administration of Thomas' estate was granted to his widow Eleanor on 20 Apr 1814. William WALKER of Thirsk, gentleman, and Joseph BURNETT of Husthwaite, farmer, were guarantors/bondsmen. Eleanor married Joseph BURNETT sixteen months later. Joseph was Thomas' brother - a case of 'keeping it in the family' and at the time legally questionable! The other bondsman, William WALKER, was probably a close relative, perhaps the father of, Marmaduke WALKER who married Thomas' niece, Ann BURNETT [daughter of his brother Robert BURNETT of Norton le Clay] in 1839.


Eleanor APPLETON

Eleanor had an illegitimate daughter, Elizabeth, born and baptised in Eston, Yorkshire, in 1800. It is by no means certain that Thomas BURNETT, whom she married in 1801 at Eston, was the father of Elizabeth - but it is likely. Thomas died in Oct 1813 and Eleanor was granted administration of his 'estate' in Apr 1814 - Joseph BURNETT, farmer of Husthwaite, and William WALKER of Thirsk, were guarantors/bondsmen.

Shortly after the death of her husband Thomas, Eleanor married her brother-in-law, the above mentioned Joseph BURNETT. It is probable that there was one child of the marriage before Eleanor died in 1818. Eleanor was living at Balk, Yorkshire, at the time of her death and 1871 census returns for Westminster, London, include a Joseph BURNETT, age 54, born Balk, Yorkshire. It seems very likely that Joseph, born c1816, was a son of Joseph and Eleanor BURNETT - though his baptism has not been found.

Shortly after Eleanor's death the Court Leet of the Manor of Husthwaite held on 23 Apr 1818 transferred tenancy of land known as "Gawber Gills" to Eleanor's son Thomas BURNETT, aged 14yrs. Joseph BURNETT "his next friend and guardian", assumed to have been Eleanor's second husband, appeared on behalf of Thomas.


162. Elizabeth APPLETON

Elizabeth was described as the "natural born" daughter of Eleanor APPLETON in the Eston baptism register. Her father was not named. Date of birth was given as 9 June Elizabeth's mother married Thomas BURNETT, of Husthwaite, in Dec 1801. It is possible that the Elizabeth BURNETT, daughter of Thomas and Eleanor BURNETT, baptised at Husthwaite in 1813, was this same Elizabeth APPLETON. The second baptism may have been a formal recognition of her 'adoption' by Thomas BURNETT.


165. Jane BURNETT

Jane married William DEE at Billingham on Tees in County Durham in 1839. William was a publican and 1851 census returns show that he was 'landlord' at the "Half Moon" inn on the Village Green at Billingham.[HO107/2384, folio 14, p20]

Robert and Mary Ann obviously moved to Ripon sometime between 1851 and 1854. Robert died there in December 1857. He left a will, proved at Wakefield on 20 Apr 1858. Mary Ann died at Ripon in August 1875. She also left a will, proved at Wakefield on 30 Aug 1875.

169. Ann BURNETT

As well as three daughters Ann had at least one son with her husband Marmaduke WALKER. When her mother Mary Ann BURNETT died, on 13 Aug 1875, she left a will which named Stephen Burnett WALKER of Addington Lodge, Croydon, Surrey, farmer, grandson, as a co-executor.

Ann died before 7th October 1854 - a marriage notice printed in the 'Harrogate Advertiser' on that date described Ann's sister Isabella as "the only surviving daughter of" their father Robert BURNETT. Ann's premature death is confirmed by the fact that her husband Marmaduke WALKER was recorded as a widower in 1861 census returns [see below].

Isabella was born 15yrs after her sister Ann, the only other known child of Robert and Mary Ann BURNETT.

113. Joseph BURNETT

Joseph married Eleanor BURNETT, the widow of his deceased brother Thomas, ie. his sister-in-law, in 1815. The marriage was perhaps frowned upon but was nevertheless legal - though it only lasted two years before Eleanor died in 1817. Joseph later married again - he married Ann NICHOLSON in 1822.

At a court leet of the manor of Husthwaite in 1818 Joseph was described as the "next friend and guardian" of Thomas BURNETT, son of Thomas and Eleanor BURNETT, when tenancy of land was transfered to young Thomas.
